Conditions of use
1. Acceptance of these Conditions:
Any references to Boss Sound and Communications in this document which refer to Boss Sound, Boss sound and Communications, Boss Sound and Co, Bosssound.ca, or their associates, subsidiaries and designees are considered to be appropriate by Boss Sound and Communications.
This Agreement is between Boss Sound and Communications and you and all the persons you represent concerning your usage and access to Boss Sound and Communication’s Bosssound.ca website as well as all information, products, content and services provided through or available on this website (collectively, the "Web site"). The purpose of this agreement is to provide benefit to both Boss Sound and Communications, its service providers, suppliers and all other persons who are associated with Boss Sound and Communications as well as you and those you represent.
Boss Sound and Communications reserves the right to make any changes at any time to Bosssound.ca and its Condition of Use and Legal Notices without any prior notice. Upon usage of bosssound.ca you should review the current (at the time of usage) Conditions of Use, Legal Notices and Privacy Policy which apply to you as a customer, user, and visitor. If bosssound.ca, its content or Conditions of Use and Legal Notices, dissatisfy you, you are not authorized to continue to use the Boss Sound and Communications Web site. Boss Sound and Communications will only honour any Policy of Condition of Use created and approved by Boss Sound and Communications, therefore any tampering made to the Conditions of Use, Privacy Policy and Legal Notices will not be considered valid.
Once you have entered bosssound.ca you signify your acceptance and agreement, and the acceptance and agreement of any person you claim to represent, to be bound by this Agreement and any others on Boss Sound and Communication’s Web site as it then reads, and you represent and warrant that you have the legal authority to agree to and accept this Agreement on behalf of yourself and any person you claim to represent.
Any type of fraudulent activity, including, but not limited to, using buying agents, misrepresenting the identity of a user(s), tampering with the site or information associated with the site, are prohibited on the site.
2. Disclaimer and Limitation of Liability
Upon usage of the Boss Sound and Communications Web site, you clearly and expressly agree that your access and use of the Boss Sound and Communications Web site is at your own risk. The Boss Sound and Communications Web site is available on an “AS AVAILABLE” basis. Boss Sound and Communications and its Associates do not warrant the accuracy, integrity or completeness of the products offered for sale or the content provided on the Boss Sound and Communications Web site or the or services offered on the Boss Sound and Communications Web site. No oral advice, information or any other statement given by Boss Sound and Communication or its Associates shall create a change to our Conditions of Use, Legal Notices or Privacy Policies or create a change to any information or content, including, but not limited to, product pricing and information available on the bosssound.ca. Neither Boss Sound and Communications nor its parent company, associates, designees or subsidiaries nor each of their respective directors, employees, agents, third-party content providers, designers, contractors, distributors, sponsors, merchants, licensors or the like (collectively, "Associates") warrant that use of the Boss Sound and Communications Web site will be uninterrupted or error-free
Under no conditions shall Boss Sound and Communications or its Associates be held in any way responsible for any direct, indirect, accidental, incidental, consequential or special, punitive or exemplary loss or damages that result from your usage of or incapability to use Bosssound.ca, including, but not limited to dependence on using the Boss Sound and Communications Website which may result in interruptions, mistakes, exclusions or omissions, deletion or corruption of files, loss of business, markets , income, profits, production, reputation, or goodwill or income loss or delays in operation or transmission, viruses or any failure of performance. The abovementioned Limitation of Liability shall hold relevance in any action, whether in contract or any other claim, even if an authorized representative of Boss Sound and Communications has come to know of or should have prior knowledge of the likelihood of such damages. You as a user of Bosssound.ca hereby acknowledge that this paragraph shall apply to all content, merchandise and services available through the Boss Sound and Communications Web site. Some of the previously stated may not apply in Quebec, so they may not apply to you.
3. Permission to Use the Website.
The Web site of Boss Sound and Communication can only be used if you meet the following conditions:
(a) You have met the common age of the location in which you reside and according to the law you can form legally binding contracts.
(b) If you reside within a location where jurisdiction states that access to or use of the website is not prohibited and legal.
It is completely and solely your responsibility, and not at all of Boss Sound and Communications and its Associates, to ensure your usage if Bosssound.ca is lawful, and you must comply with all applicable laws. At the moment (as long as this Agreement is valid) Boss Sound and Communications only ships products within North America through Bosssound.ca, but will ship to other countries across the globe upon contact to Boss Sound and Communications. Boss Sound and Communications reserves the right to request proof of lawful identification and age (for example, proof of your ability to legally able to use Bosssound.ca and to own a credit card).
4. Product Appearance
Boss Sound and Communication makes its best attempt to provide product images which accurately display the appearance (including but not limited to colour and shape) of products. However, it is still not guaranteed that the appearance matches the actual product appearance, as the appearance of the product depends, in part, upon the monitor you are using.
5. Pricing Procedures
Prices and selection shown online may differ in comparison to those in our stores, but not necessarily. Prices and offers are subject to change without any prior warning.
6. If Errors are to Occur:
Errors may occur and will be corrected where discovered and as soon as identified. Boss Sound and Communications reserves the right to invalidate any stated offer and to correct any errors, omissions or inaccuracies including after an order has been made by the user and whether or not the order has been completed and your credit card has already been charged. Boss Sound and Communications will issue a credit to your credit card equivalent to the amount charged, if your credit card has already been for the purchase and your order is cancelled. Individual bank policies will dictate when this amount is credited to your account. If not satisfied with the purchase made, you may return it in accordance with Boss Sound and Communication’s Return Policy.
7. Payment
To make payments for your orders and to complete your purchase you can pay via PayPal or contact us for further payment options. Boss Sound and Communications currently accepts MasterCard® and Visa®.
In most cases, Boss Sound and Communications will not charge your debit or credit card until we have shipped to you or confirm store availability (at which point you will only be charged for the products we have actually shipped along with any other taxes and fees which may apply). We may also pre-authorize your order amount with you debit or credit card issue at the time the order is made, which can possibly have an effect on your available line of credit. Please contact your credit card issuer for more information.
8. Order Validation
Once an order is made via shopping cart, for security purposes we will validate the information you have provided us with by verifying your method of payment and shipping address. We reserve the right to reject any order you have made with us, and/or limit quantities in any order, without any reason. If your order is rejected, we will attempt to notify you via e-mail, the one which you have registered in your account.
Your credit or debit card will be refunded if the order is rejected, but in the rare event that your card is charged we will refund the charged amount against your card.
9. Order Confirmation
Once you receive a receipt for your order, it does not mean your order has been accepted by Boss Sound and Communications, nor does it constitute confirmation of our offer to sell. The Boss Sound and Communications Web site reserves the right at any time after receipt of your order to accept or decline your order without giving a reason.
10. Order Limitations/ Limited Quantities
Limitations or cancelations of quantities purchased per person, per household or per order may be made by Boss Sound and Communications, at its own discretion. Boss Sound and Communications also reserves the right to reject any order placed. Some restrictions include but are not limited to orders placed by the same Boss Sound and Communications Web site account, the same credit or debit card, and orders which use the same billing and/or shipping address. In the event we make a change to an order, we will make attempts to notify you by contacting the e-mail and/or billing address provided upon the composition of the order. Boss Sound and Communication reserves the right to prohibit sales to dealers via Bosssound.ca, for further information dealers may contact us at (416)-674-8445.
11. Shipping
Boss Sound and Communications ships the products sold as quickly as possible upon confirmation of the order. At the moment we are shipping through Purolator, UPS as well as Canada Post, to ensure efficiency and to meet all your needs. To track your purchase simply login to you account, click on ‘My Account’, then head locater ‘Customer Orders’ and the information for your order will be available there. Pickup is also available from our below location with prior notice, along with your PayPal invoice print out, your credit card and identification.

To ensure Canadian laws are followed we include the correct costs on all paperwork traveling over the border or overseas. Therefore Boss Sound and Communications maintains no responsibility for charges accumulated due travel. If there happen to be excess fees, they are not included in the fixed Shipping and Handling Charges.
12. Returns
In the event that a you are not fully satisfied with the a purchase from Boss Sound and Communications, you may send it back within 7 days of receipt and Boss Sound and Communications will exchange, credit or refund the purchase if, and only if, it complies with both our Return Policy and our Limitations.
Return Policy
Most products may be sent back and return or exchange will be made on the purchase by Boss Sound and Communications within 7 days of the receipt. However, certain products may not be refunded, including but not limited to those considered special orders. In the event of a return or exchange, shipping is the sole responsibility of you, as a customer. The original shipping and handling charges for the returned or exchanged product will be deducted from the amount returned or credited. There may also be applicable restocking fees which will be deducted from the refund or exchange. If the event is returned, due to refusal of acceptance, additional freight charges will be reduced from the return or credited amount.
If, in the rare instance, a product arrives damaged or cannot be repaired, Boss Sound and Communications will pay for a replacement to be shipped if the damage, shortage or faulty shipping is properly signed for. If damage, shortage, or loss is not signed for, the shipment of replacements may not be possible. If you, the customer, do not wish for parts or a replacement unit, a credit may be issued for the product as stated above.
Boss Sound and Communication does not offer cancelations upon products which have been previously been shipped upon date of the cancelation attempt. The costs of round-trip shipping will be deducted from refunds if orders are refused.
Any purchase or order which is denied, returned or credited due to dissatisfaction of the product or is claimed to have been cancelled before it was shipped, is standard reason for return as there is no defect within the product. Therefore credit will be issued as stated above.
Any credit for returned items will be processed once the products are received by the distribution center and confirmation is made of the return by the distribution center. Any questions regarding the return policy can be made prior to or subsequent to placing an order by simply contacting Boss Sound and Communications at416-674-8445.
Limitations
Boss Sound and Communications reserves the right to not allow refund or exchange for certain products under certain conditions:
- Electric shavers
- Products, in general, which have been damaged by the customer and not due to shipping or due to Boss Sound and Communications in anyway.
- Products which packaging has been damaged, by the customer and in no way by Boss Sound and Communications or its Associates or Service Providers, to a great enough extent, which will be determined by Boss Sound and Communications upon receipt at the distribution center.
- Consumables, including but not limited to, the form of batteries, recordable CDs/DVDs, cassette tapes or light bulbs cannot be returned.
- Any product which has been returned to the distribution center without is original packaging.
- AV furniture that has been put together or removed from its original packaging.
- Any form of connectors, whether for Audio or Video or any other connectors sold on Boss Sound and Communications Web site.
- Televisions of the sizes 40’ or above
Headphones/Earphones
Due to hygienic reasons, no returns will be accepted on any product which falls under the subcategory ‘Head Phones’ on Bosssound.ca. If, as approved by Boss Sound and Communications, the products which fall under the ‘Head Phones’ category are refunded a mandatory 35% restocking fee, along with shipping charges will apply.
Final Sales
Certain products are sold under the condition of 'Final Sale' which means these items are not a part of the Return Policy. Upon addition to the cart a notification will be given stating the product is a ‘Final-Sale’ item.
Manufacturer Warranty
Boss Sound and Communications offers manufacturer warranty upon most, if not all, of its products, therefore after 7 days of receipt, if the product is found unsatisfactory for any reason, the manufacturer is responsible and thus should be contacted. Boss Sound and Communications and any of its Associates, cannot at all be held liable beyond 7 days of the receipt. If you need information to contact the manufacturer you can contact Boss Sound and Communications at 416-674-8445 or search for the manufacturer’s website online.
In general most manufacturers offer a one-year warranty for their products upon purchase from the retailer. However, some manufacturers may offer a longer or shorter warranty on some or all of their products. Your warranty begins upon the day you have received the product from Boss Sound and Communications and it has been confirmed by the shipping company.
13. Security
Boss Sound and Communications Web Site ensures the personal you provide us with is securely transmitted by using the Secure Sockets Layer (SSL) software, which encrypts any and all information transmitted between you and Bosssound.ca. None of the information you provide us with is revealed to any other source other than Boss Sound and Communications and its Associates. However, to ensure your safety you should log off after you have finished visiting the site, as Boss Sound and Communications is not responsible if tampering is made to your account from your end or due failure to log off.
14. Protection of Users and Law Enforcement
Personally identifiable information may be released to third parties and organizations when Boss Sound and Communications feels it is appropriate for us to do so to comply with the law; including law enforcement investigations, in order to comply with court orders or subpoenas, to protect the legal rights of Boss Sound and Communications and its Associates and you, or when it is felt necessary to comply with fraud protection and/or credit risk reduction.
The information collected by Boss Sound and Communications via Bosssound.ca is usually provided when, from your account, a search or purchase is made, upon participation within a contest, sweepstakes or online survey on bosssound.ca or upon communication with any one of our departments, including, but not limited to customer service, sales or technical services through Boss Sound and Communications Web site, telephone, fax or mail. You also provide Boss Sound and Communications with information upon creation of an account. Some of the information you provide includes, but is not limited to name, address, telephonenumber, debit or credit card information, e-mail addresses and financial information.
15. Using Our Information
Boss Sound and Communications prohibits the usage of any content on its Web site without consent of Boss Sound and Communications. To request permission to do so or to provide a link to any of the pages of Boss Sound and Communications Web site please contact us first. Boss Sound and Communications reserves the right to cancel and revoke any permission it may give to link its Web site at any time, without any prior notice or liability. Scrapping, framing, mirroring or data-mining of the Boss Sound and Communications Web site or any of its content in any form is strictly prohibited. You may not at all, with your use of the Web site, post comments, communications or any other data of any kind of data to or on the Web site with the intention that those postings may be viewed by other users of Boss Sound and Communications Web site.
16. Termination
Boss Sound and Communications, notwithstanding any other provision of this Agreement, may, in its sole discretion change, discontinue, modify, restrict, suspend, or terminate your account, your use of the Boss Sound and Communications Web site or the Web site or any part of it without any notice or liability to you or any other person. Boss Sound and Communications may at any time terminate, permanently or temporarily, this Agreement. You, yourself are liable for any orders that you place or charges under your account prior to termination.
